MJSC (Pty) Ltd. has extensive experience in management of Business IR Matters through consultations, investigations, union matters, Bargaining Council discussions, grievances, CCMA cases, Disciplinary Hearings, etc.

In partnership with Labour Attorneys, MJSC (Pty) Ltd. has established that the need within the Labour Market of South Africa has become a matter of concern for Businesses whereby Labour Laws are amended constantly and the Employees are easily referring cases to the Dispute Resolution Commissions, which cost Businesses thousands in Labour Consultant and Lawyer fees at the end of the day. In accordance to Section 25 of the LRA, the employee has the right to object to any external legal representation which leaves Businesses with limited knowledge on IR and to settle rather than to go through a legal process that is unknown.

MJSC (Pty) Ltd. is not lawyers and will provide Businesses with the peace of mind that a case can be managed at the Business and possible elimination of referrals, through effective and corrective actions during a dispute.

Businesses must ensure that all cases / incidents are well investigated, Procedural fairness is promoted and a Substantive fair decision was taken, which eliminates referral opportunity for employees. Referrals will then be ceased by the Commissioners at Conciliations at limited cost to the Business (partnerships are aligned to support Businesses in the Commissions).


CONTRACT MANAGEMENT

MJSC (Pty) Ltd. will review, amend and consult all Contracts and ensure that each employee is well informed and in agreement to the Terms of the Business Employment Relations. Standard contracts will be constructed for the Business usage in future appointments.

In terms of Legislation, each employee working for an Individual or Business through rendering a service (skill) against an agreed remuneration (not less than the minimum wage of the sector), must do so under a Contract of Employment that establishes the Terms of such Contract work and skills required (this is even for a Domestic worker).

Employee rights are very clearly stipulated within the Law, whereby each person / individual that works for some type of remuneration has the right to be informed of the responsibility level and output / skill required to be performed for such remuneration (Job Description).

DISCIPLINARY ACTIONS

Employers with employees must ensure that there are rules and regulations (Disciplinary Code) in place which sets the acceptable behavior of employees within the Business.

MJSC (Pty) Ltd. ensures that your business has a comprehensive Disciplinary Code and Procedure in place to which transgressions can be managed. MJSC (Pty) Ltd. furthermore ensure that your management is well informed and trained to manage employee behavior. We support the business through investigations of incidents, preparation of charges (Statement of Evidence) and Chairing of Hearings that will keep businesses out of the CCMA. In case where an employee refers a case to the CCMA, the business is supported through MJSC (Pty) Ltd. by a well-established Attorney firm.

MJSC (Pty) Ltd will ensure professional legal representation at the CCMA or Bargaining Council which will increase the business chances of winning a case as referred.
